posibil sa stailegal in UK numai cu RESIDENT CARD?

    Buna seara

    va rog 5 minute daca aveti timp, si daca ne pteti ajuta cu informatii.
    Sincer dupa telefoane si telefoane in UK eu si prietenul meu nu mai stim care este procedura corecta prin care am putea locui imrpeuna.
    Eu,romanca, cetatenie romana, lucrez din 2007 in Germania, momentan detin Arbeitsgenehmigung (permis pt orice tip de munca), dar numai pt Germania. Vorbesc fluent engleza, italiana si germana.
    El, italian, nu gaseste job in Germania(nu vb limba, e incepator) si acum colac peste pupaza ofertele vin din UK.
    Nu am reusit sa locuim pina acum impreuna tocmai din acest motiv, ca eu am nevoie de permis de munca pt a pleca in UK, Irlanda etc. De 2 ani tot ne chinuim sa vedem unde am putea locui/munci impreuna. Nu ne putem casatori pentru ca el e inca in divort...

    Va rugam din suflet daca va este cunoscut un caz asemanator.

    Sincer nu vreau sa traiesc acolo ilegal, am platit totdeauna taxele si am fost in ordine tocmai ca sa nu am dureri de cap.
    Zilele trecute, cautat, citit pina ce in sfarsit am citit in "guidanceromaniabulgaria0408.pdf" ca eu as putea fi considerata "Family member" daca ma mut cu el in UK deoarece as locui cu el in calitate de "civil partner". Ne gandeam ca asta ar fi o solutie temporara pina imi gasesc un job si reusesc permisul de munca.
    Este posibil sa obtii "RESIDENT CARD" daca nu esti casatorit cu un cetatean EU , insa el poate declara ca locuim impreuna in UK, descurcandu-ne cu un salar si ca eu, nu sunt un pericol pt societate in UK?
    Exista un termen limita pt mine pina cand ar trebui sa gasesc/am un job?

    Informatii primite azi dua nu mai stiu cate apeluri
    Azi telefoane peste telefoane (a sunat el, eu sunt toata ziua la job)
    - intai la UK migration border agency +448450105200 , care spun ca as putea aplica prin ambasada UK pt FAMILY MEMBER PERMIT, deoarece sunt intr-o relatie cu el,
    - apoi a sunat PERMITS2WORK Ltd... care insa nu erau prea informati la inceout, ne-au raspuns pe email. Ei spun ca ar trebui sa aplic pentru FAMILY MEMBER PERMIT,(si ca as putea sa lucrez cu acest document in primele 6 luni...e adevarat??) si dupa 6 luni sa aplic pt REGISTRATION CERTIFICATE.
    - A mai sunat el inca o data UK migration border agency, de la care a primit un alt raspuns: Aplica pt resident form EEA1
    - Apoi a sunat la PERMITS2WORK , care i-au dat o alta varianta : singura care o stiam de un an si ceva , sa gasesc firma care imi face permis de munca folosind calea: formular WP1, care se poate folosi pt form BR3.

    poate ne poate ajuta cineva sa iesim un pic din ceata....

    Te referi la German Residence Card? Nu are nici o legatura cu nimic- atita timp cit esti membru EU. Nu te intreaba nimeni, nu trebuie sa dovedesti, si din pacate nu-ti da drept de muncA, deci nu-ti foloseste la nimic.
    Ceea ce va fi bine ptr tine este cind / daca/ o sa aplici pt EEA F Permit pe care l-ai mentionat in linie cu partenerul tau ITA care are drept nelimitat de munca. Iar tu, fi linistita ca a veni aici fara documente nu inseamna deloc ca traiesti ilegal!

    imi cer scuze.
    Poate nu am fost destul de clara, ma refer la UK RESIDENT CARD.

    Aici in Germania sunt in regula, nu mai am nevoie de alte documente.

    Tu ai scris "EEA F PERMIT"...voiai sa spui EEA1?

    Scuze cei de la UK Border Agency Home office, o persoana specializata pt romani si bulagri, i-au spus ca pentru a demonstra ca suntem impreuna trebuie documente care sa asteste acest lucru de cel putin 2 ani, inseamna 2007-2009, noi din pacate nu avem asa ceva.

    Stiti cumva ce document trebuie pentru a demostra "civil partnership certificates"....sau la cine m-as putea dresa pt mai multe informatii?

    In formularul EEA1 pag 2, este scris
    "If the family member is a relative other than a child (eg parent, brother, sister, cousin), please provide appropriate documentary evidence to confirm the relationship (ie full birth, marriage or civil partnership certificates)."

    Cat timp pot sa stau in UK fara sa ma inregistrez? (din cate am inteles la asta serveste formular EEA1)

    Multumesc anticipat si imi cer scuze pt intrebarile care imi vin tot citind documente

    Din cite stiu eu " civil partnership" nu poate exista intre 2 membrii EU ( pt ca sint membrii EU si au aceleasi drepturi de rezidenta in UK) si nici intre cupluri de sex opus ( adica voi). Civil partnership este intre persoane de acelasi sex, si de obicei cind una dintre ele nu este membru EU.
    Iti spun asta din experienta, lucrez in domeniu de 4 ani si nu am vazut niciodata cuplu EU, de sex opus, in civil partnership!
    Banuiesc ca daca ai aplica pt asa ceva, ai primi refuz, pe baza ca nu exista.

    Civil Partners and Durable Relationships
    The Directive considers civil partners (based on the meaning given in paragraph 59 of Schedule 27 to the Civil Partnership Act 2004) as family members. In addition, the partner of an EEA national who is in a “durable relationship” with the EEA national may have his/her application considered under the 2006 Regulations as an extended family member. The partnership should be assessed on the basis of the criteria stipulated in Chapter 5, section 1 of the ECIs.
    Example 3: A Russian national wishes to travel to the UK with his Lithuanian partner. They are not civil partners. The Russian national will be an extended family member under regulation 8(5) of the 2006 Regulations if he can show that the relationship is a durable one on the basis of the criteria stipulated under Chapter 5 of the ECIs. As an extended family member he may be granted an EEA family permit if it is appropriate in all the circumstances to do so.

    1.3 Partners
    Regulation 8 of the 2006 Regulations covers partners of EEA nationals, i.e. common law partners and same-sex partners when no Civil Partnership has been entered into but the third country national is in a ‘durable’ relationship with the EEA national.
    Conditions for qualifying for a residence card as a non-EEA national who is in a durable relationship with an EEA national exercising Treaty rights in the UK.
    When deciding whether a partnership is durable for the purpose of an application under Regulation 8(5) the following criteria should be applied:
    • The parties have been living together in a relationship akin to marriage which has subsisted for two years or more.
    • The parties intend to live together permanently.
    • The parties are not involved in a consanguineous relationship with one another, i.e. they are not blood relatives who would not be allowed to marry as it would constitute incest.
    • Any previous marriage (or similar relationship) by either partner has permanently broken down.
    If these conditions are met then consideration can be given to issuing a residence card.
    • Under no circumstances should a person be granted a residence card on the basis of a durable relationship if s/he is not lawfully resident in the UK at the time that the application is made.
    Although a non-EEA national can be considered on the basis of Regulation 8 if s/he has provided proof that s/he is in a durable relationship we have discretion with regard to the issue of a residence card. We should not seek to exercise discretion in
    his/her favour in instances where the non-EEA national is not lawfully resident in the UK.
    Any decision to refuse an application made by a common-law partner should be referred to a senior caseworker.

    Multumesc mult pt inbformatii. Din pacate eu si prietenul meu nu putem aplica/ declara ca am trait 2 ani impreuna, dar am inceput cu inscrierea pe aceeasi adresa la primaria din Stuttgart. Pina ce vom reusi sa dovedim asta dureaza si din aceasta cauza voi incerca cu Blue card.

    Voi trimite diploma de Colegiu uNiversitar la NARiC sa mi-o incadreze in sistemul lor si sper sa obtin BA, Bsc..
    Asta cred ca m-ar ajuta plus cat am lucrat in Germania, si test in Engleza si toate cele.

    Daca va fi cazul cred ca va voi mai deranja cu intrebari.
