    You must be in the United Kingdom to apply.
     6. BRITISH CITIZENSHIP

    There are few ways of acquiring British citizenship; and it is also important to note that although British citizenship can be acquired by birth, not all children born in the UK are British citizens. Some people may also have to either Register as British or Naturalize to become British.
    British citizenship can, therefore, be acquired in the following ways:
    BY BIRTH
    The legal sources of British Citizenship are contained in the British Nationality Act of 1981 which abolished citizenship by birth in the UK. Children born in the UK after commencement of this Act, will only become British citizen if at least one of the their parents is British or settled in the UK. From 1st July 2006, children can become British through their father even if he is not married to their mother.
    BY REGISTRATION
    Registration as of right will apply to:
    A child born in the UK on or after 1 January 1983, who is not British citizen at birth but one of whose parent(s) later becomes a British citizen or becomes settled in the UK.
    A child born in the UK on or after 1 January 1983 who is not a British citizen at birth, but who lived continuously in the UK for 10 years with an absence of not more that 90 days in any year (if any).
    A child born outside the UK on or after 1 January 1983 by parents who are themselves British citizen by descent.
    Other applicants:
    There are other categories of applicants, information and criteria for which can be found on the Home Office web site.
    BY NATURALIZATION
    SPOUSE OF A BRITISH CITIZEN:
    An applicant under this category must:
    be 18 years of age or over;
    be of a sound mind;
    be of a good character;
    be married to a British citizen up until the date of application;
    at the date of application, be resident in the UK and should not be subject to any time limit;
    meet the “ 3 year residence” requirement;
    pass Life in the UK test
    Other applicants:
    be 18 years of age or over;
    be of a sound mind;
    be of a good character;
    intend to live in the UK;
    not be subject to any time limit on his leave in the UK in the last 12 months prior to the date of application;
    meet the “ 5 year residence” requirement;
    pass Life in the UK test

    If you wish to apply for permanent residence in the United Kingdom as a citizen of Bulgaria or Romania who is here to establish in business under the terms of the former European Community Association Agreement (ECAA) that applied until those countries joined the European Union (EU) on 1 January 2007. The ECAA lapsed on that date and citizens of Bulgaria and Romania may now exercise their treaty rights of self-employment as citizens of the European Economic Area.
    In addition to your initial permission to come here in this category, you will need to have been given at least one extension of your stay. You do not need to obtain a second extension, even if this means your permission to stay here expires before you have lived here for five years. You must meet all the requirements of the ECAA throughout the five years.
    You may apply for permanent residence if you are established in business and you:
    are a citizen of Bulgaria or Romania, and entered the United Kingdom with a valid visa as a person intending to establish in business under the provisions of an EC Association Agreement, and
    were given an extension of stay before 1 January 2007 to remain in business under the provisions of the agreement, and
    were established in business in the United Kingdom, spent a continuous period of five years in the United Kingdom in this capacity and are still in that business, and
    met the requirements in the paragraph below throughout those five years, and
    submit accounts for the first four years of trading, and
    management accounts for the fifth year, and
    have sufficient knowledge of language and life in the United Kingdom.
    The requirements mentioned above are that throughout the five years:
    your share of the profits of the business has been sufficient to maintain and accommodate yourself, and
    any dependants without you needing to seek other work or help from public funds, and
    you have not taken or sought other work (apart from your business) in the United Kingdom, and
    you have also met the requirements in one of the two categories below.
    If you have established yourself in a company in the United Kingdom which you effectively control, the requirements are that:
    you have been actively involved in the promotion and management of the company, and
    you have had a controlling interest in the company, and
    the company was registered in the United Kingdom and has been trading or providing services in the United Kingdom, and
    the company owned the assets of the business.
    If you have established yourself as a sole trader or in a partnership in the United Kingdom, the requirements are that:
    you have been actively involved in trading or providing services on your own account or in a partnership in the United Kingdom, and
    you owned, or together with your partners owned, the assets of the business, and
    in the case of a partnership, your part in the business was not actually employment that you pretended was a business partnership.

    Ma rog, asa o fi, eu din primul tau post nu aveam cum sa inteleg asta - sincer nici acum nu inteleg pentru ca ai pus o groaza de paragrafe din care nu inteleg care e cazul. Daca zici tu ca nu ti se aplica tie chestia cu 6 ani, foarte bine, bravo. Afirmatia mea este bazata pe urmatorul paragraf din formularul AN, pe care va trebui sa il completezi pentru cererea de cetatenie:

    EEA nationals exercising EC Treaty Rights
    2.4 If you are an EEA national or the family member of an EEA national, please complete the following section,
    showing on what basis you were in the United Kingdom for the last 6 years. This is so we can see whether you were
    exercising your Treaty Rights for a continuous period and have acquired permanent residence in the United Kingdom.

    Si uite in ghidul pentru aplicantii pentru cetatenie, la sectiunea despre EEA nationals:

    New immigration regulations came into force on 30 April 2006. If you are a national of a
    country which is a member state of the EEA or Switzerland, or the family member of such a
    person, you will automatically have permanent residence status after exercising EEA free
    movement rights in the UK for any continuous period of 5 years ending on or after 30 April
    2006, and therefore will not have to apply for indefinite leave to remain.
    But remember
    that, unless married to or the civil partner of a British citizen, you should normally have
    held permanent resident status for 12 months before applying for naturalisation. This
    means that you may need to wait until you have been in the United Kingdom for 6 years
    before you can apply.

    Repet, nu cunosc circumstantele tale personale, nu stiu cand ai venit, etc. Incercam doar sa iti dau un sfat pentru ca m-am interesat si eu de acelasi lucru si asta am vazut. "Excuse my interference: it was kindly meant." -ras4-

    Pai ai putea sa le arati chitante daca mai ai - de la plata utilitatilor daca au fost pe numele tau, extrase de cont bancar cu iesirile ca banuiesc ca ai platit prin card si astea apar, cu plata chiriei daca o faci prin standing order, si asta apare pe extrasul de cont... daca nu le-ai pastrat banuiesc ca poti sa ceri copii de la banca dar mi se pare ca trebuie sa platesti. Data cand ai venit... hmm, mai ai biletul de avion sau de ferry sau de Eurostar sau, ma rog, cu ce ai venit? Vreo corespondenta privind plecarea catre UK? Stiu ca suna absurd, poate nu l-ai pastrat, dar totusi, orice document cat de mic ajuta, ma gandesc... Bafta.

    Testul ala de Life in the UK nu-ti trebuie cand aplici de Rezidenta permanenta (EEA3 form) ci doar cand aplici pentru cetatenie (AN form) ca sa fie mai clar..?

    Eu si sotul am trecut cu brio testul Life in the uk, chiar saptamana trecuta -ras4-
    Din ce mi-amintesc, uite cateva intrebari ce mi-au picat: cine erau 'serfs'?, coasta de est a Americii a fost colonizata in timpul carui rege/regine?, in 1745 cine a fost ajutat sa il inlocuiasca la tron pe George al 2lea? , ce sunt 'small claims'?, BBC este sau nu controlat de Guvern?, cu cine a fost purtat razboiul din Crimea, unde locuieste Prim Ministrul, intrebari legate de batalia de la Trafalgar, criminal law, values and responsibilities, Sir Roger Bannister.
    Deocamdata atat imi amintesc acum, mi s-a parut usor testul, dar adevarul e ca am stat un pic cu burta pe carte -da-da-
    Bafta tuturor!
