    Dar nu e grav, nici eu nu le stiu pe toate. Tuturor ne mai scapa cate ceva din cand in cand! De asta suntem o echipa ca sa ne acoperim unii pe altii!

    Elly, citatul dat de tine nu mai este 100% valabil in acest moment. HO a mai modificat putin situatia, astfel ca dependentii nu mai beneficiaza de acces nerestrictionat pe piata muncii. Ei trebuie sa aplice pentru un worker accesion card.Deci e o idee mai complicat decat parea in urma cu 2 luni.

    Daca nu esti in pozitia de a aplica curind(in max 12 luni) la ILR, atunci e okay, poti uza de acest community work certificat. Altfel, pierzi mult mai multe drepturi pe care nu le vei avea decit dupa 31dec 2011. ur choise, good luck. :-??

    Buna din nou,imi permit sa revin iarasi si sa va expun cazul meu.Eu am viza de self-employed.Cea de 3 ani imi expira in Oct 2007.Dupa cate am inteles din formularul Br1,sotia mea,care a lucrat deja mai mult de 3 ani legal(stiu ca e minim 12 luni),poate aplica pentru acel card de acces nelimitat pe piata muncii de aici.Eu as vrea sa renunt la pozitia de Self-emp si sa devin angajat.intrebarea mea este:Imi baza faptului ca sotia mea va avea drept de munca nelimitat,eu voi putea deveni dependentul ei si sa aplic si eu cu Br1 dupa ce primeste ea acel card?Sau cum ma sfatuiti sa fac mai bine?Stiu ca pentru indefinite trebuie sa astept pina in 2011-2012,dar sunt sigur ca pina atunci Uk va ridica restrictiile pe piata muncii.va multumesc anticipat si va urez un nou an fericit!

    Este clar ca sotia ta intruneste conditiile pentru a obtine un registration certificate, iar tu in calitate de sot al ei, de asemenea ai acest drept.
    Completati un formular BR1, pe tine ca sot te va include in sectiunea 2 la family members si veti obtine amandoi cate un certificat. Nu e nevoie sa astepti sa-l obtina ea mai intai si tu dupa aceea.

    Pot fi inclusi si alti membrii de familie ? -gift- Am vazut ca sunt multe spatii goale acolo pe formular.... 3s Ce conditii sunt pt acestia (din cate am vazut eu trebuie sa locuiasca in UK, dar nu am observat sa ceara vreo dovada pt asta)?....
    Sau ar fi prea frumos....? -tongue-

    Intr-adevar sunt o gramada de spatii pentru membrii. In mod normal definitia unui membru de familie e destul de cuprinzatoare, dar din cate am citit in guidance-ul pentru romani, am inteles ca aici se incadreaza doar copiii sub 21 de ani sau cei peste daca pot dovedi ca sunt dependenti si sotia sau partenerul civil.

    Parteneru, poti sa imi citezi si mie unde ai gasit in guidance definitia "membrului de familie"? Ori am citit eu doar printre randuri? -study-

    Multumesc de lamuriri ,stiti de cineva care deja a trimis acest formular,as fi curios sa stiu cat dureaza toata afacerea deoarece nu vreau sa imi blocheze iarasi pasaportul in vreun sertar la H.O.vreun an (ca si la ultima aplicatie pt 3 ani)

    Luana_m, in guidance nu se da definitia "family member"! Din contra pana si in draftul legii, la capitolul "authorised family member" sunt destul de evazivi.
    Definitia "family member" o vei gasi foarte clar explicata in EEA Regulations 2006:

    Nu se stie cat va dura pana HO iti va trimite acel "registration certificate" deoarece ei n-au dat nici un termen si pe de alta parte, in acest moment nu avem nici un caz concret pentru a-l folosi ca si exemplu.

    nu uitati ca de data asta trimiterea pasaportului nu mai este o chestie asa de grava, datorita faptului ca puteti iesi si intra unde vreti in Europa (cu exceptia Suediei) pe baza Cartii de Identitate; acest lucru era imposibil ininte de 1 ian 2007

    nu te mai desumfla degeaba!
    statutul tau este absolut irelevant pentru Home Office.
    Sotia ta este cea care a dobindit "community worker rights" in baza faptului ca a lucrat legal mai mult de 12 luni in UK. Ea este cea care aplica pe formularul BR1 su esti adaugat ca membru de familie..ce conteaza ce faci tu? tu poti sa fii bagator de seama, sau casnica...e irelevant.

    in legatura cu "family member", aceasta notiune este foarte larga, iata ce spune chiar in BR1 sectiunea 2:

    Un roman cum este cazul sotiei lui "necrutatorul" poate adauga la acea list nu numai pe el ca sot, ci si copiii lor, fratii lor, parintii lor...

    La asta ma refeream si eu, UKOK, si m-a pus pe ganduri... -scratch- cratch- Daca astia de la HO chiar vorbesc serios?... si noi nu stim?... :)) Cum putem fi siguri? A incercat careva pana acum?

This means you have a full right to reside under EU law as a worker in a Member State and have an unrestricted right to access that Member States’ labour market."

    Catre Viruss si visa de aupair.Nu cred ca ai sanse de a obtine drept neingardit la piata muncii din mai multe motive:tu nu ai avut calitatea de angajat in aceasta tara(nu platesti Ni Number contributions,sau taxe pe salariu),aceasta asa zisa munca de aupair se considera ca si un schimb cultural ,adica tu ai venit aici sa inveti limba engleza si acei 55 de lire pe saptamina nu sunt salariu ci asa zisi bani de buzunar.H.O ti-a raspuns ca iti vor trimite acel formular pentru ca ei nu au voie sa ingradeasca dreptul nimanui sa ceara ceva,asta nu inseamna ca ti se va si da ceva!Bafta multa si asteptam concluzia aplicatiei tale,nepotul meu e in aceeasi situatie si ar fi superfericit daca intradevar ar putea aplica si el pt blue card.

    da ce se intimpla cu cei in situatia mea.adica viza de trei ani expira in martie.am dreptu pt a aplica pt cardul albastru?multumesc frumos daca stii ceva poate vrei sa i-mi zici si mie si la altii.
